Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and TimeWasted, Inc. ("TimeWasted," "we," "us," or "our") regarding your use of our time tracking application and services.

By accessing or using TimeWasted, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

Account Registration

To use TimeWasted, you must:

• Be at least 13 years of age (or 16 in the EU)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity under your account

You may not use another person's account or share your account with others. You are responsible for maintaining the confidentiality of your password.

Acceptable Use

You agree NOT to:

• Use the service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Reverse engineer, decompile, or disassemble any part of the service
• Use automated systems to access the service (except our official API)
• Collect or harvest any personally identifiable information from other users
• Impersonate any person or entity
• Upload viruses or malicious code

Subscription Plans and Payments

Free Plan

Our Free plan is provided at no cost with limited features. We reserve the right to modify or discontinue the Free plan at any time.

Paid Plans

Paid subscriptions (Pro and Team plans) are billed monthly or annually. By subscribing, you agree to:

• Pay all fees associated with your subscription
• Provide accurate payment information
• Automatic renewal unless cancelled before the renewal date
• Responsibility for all taxes associated with your subscription

Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of your current billing period. We offer a 30-day money-back guarantee for new subscriptions.

Intellectual Property

TimeWasted and its original content, features, and functionality are owned by TimeWasted, Inc. and are protected by international copyright, trademark, and other intellectual property laws.

You retain all rights to your data. By using our service, you grant us a limited license to process and display your data solely to provide the service.

Data and Privacy

Your use of TimeWasted is also governed by our Privacy Policy. We take data security seriously and implement industry-standard measures to protect your information.

You are responsible for ensuring you have appropriate rights and permissions for any data you track through TimeWasted, especially when using team features.

Service Availability

We strive to provide a reliable service, but we do not guarantee that TimeWasted will be available 100% of the time. We may:

• Perform scheduled maintenance (with advance notice when possible)
• Experience unexpected downtime
• Modify or discontinue features (with reasonable notice)

We are not liable for any loss of data or interruption of service, though we maintain regular backups and work to minimize disruptions.

Limitation of Liability

To the maximum extent permitted by law, TimeWasted shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

Our total liability to you for any claims arising from your use of TimeWasted is limited to the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold TimeWasted harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another party

Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination:

• Your right to use the service will cease immediately
• You will still be charged for any outstanding fees
• You may export your data within 30 days
• Your data will be deleted after 30 days

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the service. Your continued use of TimeWasted after changes take effect constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
